Lawyers for NH man accused of texting threats to candidates claim First Amendment protection
Lawyers for a New Hampshire man who is accused of threatening to kill three presidential candidates argue that some of the threats are protected by freedom of speech.
In a recent court filing, Tyler Anderson, of Dover lawyers, said some text that were sent to one of the campaigns are protected by the First Amendment because he didn’t make a true threat.
In a separate filing, his lawyers argued some evidence that was given to investigators shouldn’t be used because it went beyond their warrant by having Anderson unlock his phone.
Anderson was charged with three counts of transmitting in interstate commerce a threat to injure the person of another.
