Capitol riot defendant rearrested on firearm charge one day after Jan. 6 case dismissed
A Jan. 6 defendant has been rearrested on a firearm charge just one day after federal prosecutors moved to dismiss his Capitol riot case following President Donald Trump’s clemency order.
Daniel Ball, of Florida, was arrested while still in custody at the D.C. Jail on Tuesday on one count of possession of a firearm by a convicted felon. According to a four-page indictment filed in federal court, Ball has at least three prior felony convictions for domestic battery by strangulation, battery on a law enforcement officer and resisting law enforcement with violence. The case was initially filed against Ball in Florida in August, but he has been unable to appear due to his detention in D.C. on charges related to the Capitol riot.
The two cases are related, however. The firearm charge stems from the May 2023 search of his Florida residence on a warrant in his Jan. 6 case. During the search, FBI agents reportedly discovered a loaded .22-caliber rifle, rifle ammunition and multiple commercially produced explosive devices agents reported being the “same style of device Ball would later tell agents the threw at officers on January 6,” according to a detention memo filed in federal court.
